The FBI have been all over this in Knoxville (KFAR 90.9). We had 3 federal marshalls, 4 fcc agents, three FBI agents on special assignment--along with the (in)justice department churning out pages of paper on us. They came after us like we were robbing banks! It is inappropriate for federal agents to be coming down on americans practicing their first amendment. KFAR is next to the heart of the american nuclear weapons production complex (oak ridge) and surrounded by decaying TVA nuclear power plants all over our region. People know another terrorist attack is coming to this country the cowardly attack on the iraqi people has guarenteed that--not to mention the other crap that nazi thug bush is pulling. Yet all these FBIs and FCC and Federal Marshalls are hunting down our 100 watt asses! We have less power than a lightbulb. I guess its easy to pick a fight with low power community radio station that to prepare to defend against a real attack.

Our beloved radio station lives on in our hearts and minds and will resurrect. I was saddened to hear that the FCC tires were slashed...An eye for an eye makes the whole world blind. I believe we would have made a bigger impact if we had treated the Marshalls with the same respect and dignity we would have enjoyed. When we seek to punish, we lose our ability to protect.

I don't believe that the slashing of the agents's tires was an act of revenge, I believe it was an act of rage. I also don't think we need to afford willful participants in the repressive state apparatus with much respect at all (at least not while they are carrying out the state's repressive work).

The Gadabout Film Festival will take place on Tuesday October 12 from 5:30 - 9:30 PM at Barrios Unidos located at 1817 Soquel Avenue. The Gadabout is a nationally touring film festival that seeks to open new avenues of distribution for truly independent filmmakers that get pushed aside by Hollywood and the commercial film festival circuit. Forget the "free" stuff -- you want to win this battle, there's only one thing you need to learn, "federal jurisdiction". Forget the assumption that the FCC (not even part of the Executive branch) has the Constitutional authority to regulate every microvolt of radio throughout the Union (see US v Lopez). The feds are limited to "regulating commerce among the states". FM is "line of site", which is very difficult to make interstate from the Pacific Ocean.

We need to talk to the mexican radio station and see if we can do a day of action all at once. Plus--this thursday at noon we are demonstrating out side of the federal building where the FBI is located for shutting down KFAR. If yall can't do something that day do plan and action with us that we can both do and hype together. Cooridinated actions. We don't have to be joined at the hip--but we should do it a few times and see how much noise we can make together.

As far as the legal angle--good luck. FYI we found a trap here in Knoxville. They didn't have anyone to pin charges on since we are anarchist and had no "owner operator". But we found in the legal documents they left behind that we had 30 days to make a claim to get it back. We made some inquires and found out that in effect to make the claim someone would have to...claim the gear. This hands the FCC someone to pin fines on. Watch for this. Extended legal campaigns really hurt the American Indian Movement bad. They are expensive and time consuming with mixed results. We are focusing on making allot of noise--and grassroots hell raising. We have to create political pressure by being noisy and loud.

Criminals should be punished, to discourage crime. The FCC are criminals, and should be punished to discourage them from attacking
"unlicensed" radio stations which have cooperated, and co-existed peacefully, with their other broadcasting neighbors.

A broadcasting "license" is a speech license - free speech should never be subject to govt permission! If another radio station has a complaint about FRSC stomping on their signal, let that station come forward, make their accusation, and let the broadcasters be CHARGED, and then have their fair day in court!

The FCC is just another arm of Washington DC. Their authority is Constitutionally restricted to

1) matters of INTER-STATE commerce, and
2) national security.

FRSC's signal never crossed the California state border. Bloody hell, you cant even get their signal in Scott's Valley!

California has its own Constitution too, you know. Our own laws. Our own law enforcement. This is a California INTERNAL matter - no one in any other state could even HEAR the signal!

Washington DC needs to stay the fuck out of California's private business! In fact it needs to stay out of every state's private business! The Founding Fathers CREATED DC - the District of Columbia (not even a legal State) - to arbitrate BETWEEN STATES when an INTER-STATE PROBLEM occured that the states involved could not resolve between themselves.

We are no longer the United States of America, because the individual states have lost their soveriegnty to DC. We have been absorbed by force, much the same way the former USSR took over the individual Russian states.

The only difference between us and the USSR now, is that the USSR had to forcibly subjugate the individual states. They had to take over by force.

Did Washington DC ever have to militarily defeat any of the 50 states? Nope.

We still have city police, county sherrifs, and state police. WHERE WERE THEY, when DC sent its battalion of soldiers to invade California and attack FRSC? We PAY THESE PEOPLE to protect us from attack.

But when DC attacks, our police sit back and allow it!

Why?

Ill tell you why - our local police, whom we hire and authorize and pay - have betrayed us. They accept bribes from DC (called "subsidies" and "grants" resulting in increased job security and fat overtime checks for "special enforcement operations"), and with those bribes our local, county, and state police have sold their loyalty to DC.

And so they sit back and let the DC pirates have their way with us, when DC wants to come in and take something.

The Mayor of Santa Cruz, the Chief of Police, and anyone else reponsible for the failure to put wheels in motion to defend the citizens of Santa Cruz from attack by these viking raiding parties from DC, should be fired for dereliction of duty. PLAIN AND SIMPLE.

But it wont happen, I know.

It wont happen because the structure of our government, of the chain of command, and the authority structure on which our police operate, is ROTTEN TO THE CORE.

Based on what i've read here, especially considering the staion is only 37 watts and therefore presumably not even able to be heard across state lines thereby nullifying any expanded "interstate commerce" argument, all charges,etc. MUST be dropped IF the individuals present the lack of jurisdiction proof; viz., Article 1 sec 8 of the USA Constitution wherein is clearly spelled out the severe limit to jurisdiction of federal laws: "...Congress shall have power to ...exercise exclusive legislation...over such District(ie, the District of Columbia,aka Washington DC)...NOT EXCEEDING TEN SQUARE MILES.." Please read this over and over again until it sinks in:"..NOT EXCEEDING TEN SQUARE MILES.."This of course, includes the infamous reverse-named "Patriot Act" and EVERY other federal law. Just as Santa Cruz laws apply only to Santa Cruz, not China or New York or anywhere else, so do Wash DC laws apply only to DC![I'm omitting the Constitutional exceptions to this for simplicity which are miltary bases and land CEDED (not just bought/owned, but ceded by the vote of =2/3 of the Santa Cruz elected Council)]. How many thousands of people are in federal prisons now because they didn't know to raise this issue?If not raised, the Court will assume that you have volunteered into it's jurisdiction. So...Raise this in the Court(s) immediately! No federal (DC)jurisdiction on state land!!!!
PS.I suggest that instead of just resoulutions against the "Patriot" Act-400+ cities,etc. have passed such resolutions-we pass local LAWS against the feds violating the Constitutionally guaranteed inalienable rights of anyone residing in a locality where there is no fed jurisdition such that any fed agent who violates his oath of office to the Constitution by exercising power OUTSIDE his Constitutionally limited jurisdiction(DC) be sent to jail by the local authorities for a minimum of 10 years. This would , I believe, STOP their violations immediately-or at least right after a jurisdiction-violating fed is sentenced to a Santa Cruz jail for 10 years.
Incidentally, even federal law itself acknowledges this severely limited federal legislative jurisdiction.See 4USC sec.72 .."all offices [that includes FCC!]attached to the seat of government[ie,DC]shall be excercised in the District of Columbia and not elsewhere...". Lawyers do not generally like to use this juriosdiction argument as it is counterproductive to more trials/money!Find one who will!Or do it yourself without a lawyer-as was done successfully in the famous abortion clinic free speech case!Also, the federal "gun-free school zones"federal law was ruled to have no legislative jurisdiction in the states!

What about a floating ocean-borne broadcast station beyond U.S. legal reach (12 miles or so)? It is being done in the U.K. Why not here? You could power it via solar (solar panel and/or solar hydrogen) and wind. Could be a good technology demonstrator as well.
