'Penal Code PC 142a was changed last year NOT to require police to take Citizen Arrests--as they had previously been required to do. So it is a matter of police discretion.\n\nThe officers could have cited Danko had they chosen. A number of people found police use of force excessive. Danko claims he was beaten either at the police station or at the jail.\n\nThe case needs to be investigated. I have come to no final conclusions
