Last month CODEPINK, South Bay Mobilization, ANSWER, De Anza College students, faculty and others participated in a three day protest against former Secretary of State Colin Powell at De Anza College Flint Center in Cupertino. On November 11, 2005, eight students were arrested at the event; one student was arrested inside the hall for disrupting Powell's speech. Seven students were racially and religiously profiled and brutally arrested by Sheriffs outside the hall.

Press Conference 5:00 PM, Monday December 12, 2005 With Muslim & Youth of Color Racially Profiled & Brutalized By Police at Anti War Protest. Also Speaking: Their parents, Their Attorney Dan Mayfield, and Community Support Organizations.

The arrestees from the protest against Colin Powell, who have come to be known as the De Anza 8, their lawyer, and community groups will hold a press conference protesting the racial profiling that occurred in the arrests the eight individuals during the anti war protest at Flint Center on November 11, 2005. They are demanding that the charges against the De Anza 8 be dropped. Over 1500 letters have been delivered to Santa Clara County District Attorney George Kennedy demanding that the charges against the youth be dropped.

At 5:30 the Human Relations Commission will conduct a hearing raising this case.

The arrestees from the De Anza protest, their attorney, and community members who are witnesses to the arrests and the racial profiling that occurred will make statements in the hearing.

WHAT OCCURRED ON NOVEMBER 11:

There were three days of demonstrations, Wednesday, Thursday, and Friday. (November 9, 10, and 11, 2005.) Eight people were arrested at the Friday November 11 demonstration. One was arrested inside disrupting the event while seven were arrested outside the event. The seven youth arrested outside were all youth of color - six were Muslim. They were singled out and brutally arrested though they had not broken any law. Santa Clara County Sheriffs claim two of the students committed felonies though there were numerous witnesses who have stated the law enforcements claims are false.

ACTION ALERT: Urge Charges to be Dropped Against Muslim De Anza Students

(Santa Clara, 11/29/05) The San Francisco Bay Area chapter of the Council on American-Islamic Relations (CAIR-SFBA) is urging the Bay Area community to take a ction by contacting the Santa Clara District Attorney to drop charges against the arrested Muslim De Anza students.

Muslim students were arrested on November 11, 2005 for protesting former Secretary of State Colin Powell's appearance at DeAnza Community College in Cupertino. The arrests seem to have been motivated by religious and racial profiling as six were visibly dressed Muslim students and one was an African American graduate student. The arrests were brutal and many were beaten by the police. The remaining arrestee was a white adult who had intentionally disrupted Powell's speech from inside the auditorium but was arrested without any beatings.

The demonstration was largely nonviolent, yet the seven arrestees were selectively targeted by the police due to their traditional dress and their ethnicity. Other incidents during the protest included a police car window publicly smashed by other protesters; however, the individuals were not arrested. Many Muslim students just observing the protest after classes and heading to their cars were targeted by police simply due to their visible traditional Muslim dress. During the demonstration, detained protesters were allowed to leave except for the Muslim students who did not take part in violent acts.

A police officer present at the protest interviewed by a reporter said, "Many officers associate such garb to terrorists because of the training videos they see in which 'terrorists prepare themselves for Jihad and martyrdom.'"

Muslim Americans have the right to exercise their constitutional rights to free speech and lawful gathering without physical intimidation, religious discrimination and racial profiling. The Muslim community is urged to contact the Santa Clara County District Attorney to request that charges be dropped against the wrongfully arrested Muslim students.

What Happened:

On the night of November 11th at De Anza College, Santa Clara County Sheriffs tackled and beat a number of young Muslim men and one African American non-Muslim man. The night was part of three days of anti-war events and protest around the former Secretary of State Colin Powell's appearance at the Flint Center.

In a shrinking crowd of mostly white protesters, sheriffs singled out and targeted men of color in the crowd with brutal arrests. Included were two Muslim students not participating in the protest, but walking to their cars after attending a class. Sheriffs justified the attacks and arrest by charging seven of the men with various offenses. Two required hospital treatment and one was left unconscious.

This post-September 11 flavor of racial and religious profiling is an attack on communities of color and everyone's right to speak out. We should be able to participate in protest against the crimes and deceptions of Colin Powell and the Bush administration without fear of police brutality.

Take Action:

Call the Santa Clara County District Attorney, George Kennedy, at (408) 299-7400, and demand they stop racial profiling and drop all the charges against the 8 De Anza arrestees from November 11th, 2005.

Students Arrested at Powell Protest Accuse Police of Targetting Muslims

Colin Powell spoke at De Anza College from November 9th through November 11th. A peace camp and various civil disobedience actions took place throughout the three days, sponsored by a wide range of students and Bay Area anti-war organizations.

On Friday November 11th, protests started in front of the Flint Center before Powell’s third appearance. One protester got inside and was arrested and while others tried to push their way through the police line outside. While the majority of those who engaged in confrontation were white, most of the people arrested were people of color. Out of seven of the protesters who were arrested outside of the Flint Center, six were Muslims of Arabic and African descent.

"They couldn't stand that we were dressed in Palestinian and Arabic clothes...They wanted revenge so they chased down, every one of us who were Muslim, until they could beat and arrest us, that's what they were waiting for " said De Anza student Hanni Zaki, 22, who was hospitalized for receiving injury to the head from police who stepped on his face and beat him with their batons.

Brian Helmle, was the first to be arrested inside the Flint Center earlier that night, during Powell's speech and was charged for Disturbing the Peace and Resisting Arrest. Helmle, who is 27, stood up while Powell was speaking about the virtues of American kindness and yelled out "Liar - liar, murderer – murderer," and blew his whistle until officers carried him across the stands to arrest him.

Helmle, who later met with other arrestees, was shocked to find that they were treated with such harshness and brutality and that he was the only Caucasian to be arrested that night. "I think that this is all about white privilege," said Helmle. "I wasn't treated in any harshness whatsoever by the police. The fact is that the eyes of the white crowd were on a white male doing strange things inside. What happened to those outside in the protest is ridiculous and racist. All they were trying to do was leave and get to their cars. I was intentionally trying to get arrested."

Police released Helmle by 1 a.m. that same night without taking him into custody. The seven others who were arrested outside the Flint Center were taken into custody, including the minor Eltilib, and detained overnight in harsh conditions. Al-Hayiek is the only one to still be in custody awaiting an arraignment for bond.

Were the protestors arrested or detained? And what was their crime? What did the Police Department charge them with?

I will call for their release if they truly did nothing to warrant their arrest.

Most protestors probably provoked the police leading to their arrest. If you've ever watched protests on tv, there are always a few who get a little rowdy and get arrested. People need to think clearly and control themselves at such protests, not claim they are victims when they are obviously in the wrong.

And yet no one was comitting a crime? That seems slightly parodoxical... Makes me wonder about the true accuracy of this article - are there any other sources that documented this incident?

The charges range from misdemeanors like resisting arrest and disturbing the peace to two felonies; assault on an officer (supposedly grabbing the club they were being beaten with) and assault on an officer with a deadly weapon (supposedly throwing a rock). Their supporters assert that they were wrongfully beaten and that they did not commit the crimes they are accused of (except for the white man arrested on the inside and who was not beaten). I doubt that the arrestees will discuss their cases in much detail since they have attorneys who would advise them not to but that they will discuss their treatment at the hands of the police.

How will we decide who is worthy of our solidarity and support? Each of us has to have an answer to that question. I do not demand that you adopt my perspective in order to receive support if you claim that you were illegitimately targetted by the police, but like Oscar I would want to know your side.

What you see in this posting (several articles condemning the police behavior as racist since 7 of 8 of the folks arrested were Arab Muslims or African people and only 1 was white) is the "side" of the arrestees.

My perspective on the police in general is that since the police have a monopoly on violence and instant and unaccountable access to infinite escalation of violence which they use to enforce white supremacy, male supremacy, and heterosexism no matter what race or gender they themselves may be, they must be held to the tightest scrutiny possible in order to constrain them and eventually shrink them down to a size where they could be drowned in a bathtub along with the rest of the repressive apparatus of the government.

That said, I am genuinely curious to hear other people's perspectives since political repression against Muslims has been very intense since 9/11, especially with Guantanamo and the disappearances or "extraordinary renditions" of Muslims to countries where torture is accepted more openly. It looks to me like the Santa Clara County Sherrif's department is carrying out a much more cost-effective version of the anti-Muslim scapegoating of the Federal government (no plane fares, no costly detention or torture consultants). What do you think?

That is a stereotype. All terrorists ARE NOT muslims. If we wanted to profile each ethnic group based on the tiny proportion of the population who engage in inhumane behaviors, then it is the WHITE PEOPLE who should get the most scrutiny from cops. George W. Bush & Co. are the biggest terrorists on this planet! Does that mean we should harrass people who look like him or belong to the same religious group he claims (they have strongly criticized him, by the way.) Furthermore, white people have waged a war of genocide against people of African descent for over five hundred years! Germans and other Europeans tried to wipe Jews and Slavic people off the map during WWII!

If were going to start profiling people, then we shouldn't be blind sighted when looking at history

“How will you decide?? is right on some levels, but I think its less about ‘choosing a side’ and more about standing up for the truth. If the protestors genuinely didn’t do a thing and were beaten and arrested, then I will stand up for them. But since I have been involved with ‘the left’ for about a decade now, I know how often folks who break the law claim innocence.

The nation has come to be more hostile to those who look ‘Arab,’ and I don’t discount their claims. I just want to know the complete story and I don’t think this article has delivered the facts as such. And since this seems like it is going to enter a court room, we probably won’t know the facts until far later.

Of course all terrorists aren’t Muslim. Only the most far-right idiots would make such a foolish generalization. To make generalizations like “white people have waged genocide for years? is equally stupid.

I looked at your posted photos and what I see are a bunch of protesters hiding behind blue bandana's and ball caps or other garb, then knocking down a barricade and charging and pushing police officers. And then your once again surprised when someone gets hurt or arrested after such a stupid move.Then you want all the charges dropped after antangonizing the cops into action ( which is no doubt what you wanted anyway) then whine and snivel about the response and the result of your actions. And as with all the information here, you only post one side of the incident with a generous amount of personal spin to make it sound like they did nothing wrong, yet your own posted photos depict that in fact several people did wrong. And you have the audacity to claim that corperate media slants the truth?? Someone needs to clean up their own act before demanding others do the same. Lead by example for once!

OK Oscar, how about "Certain extremely racist and mysognistic white people (but mostly males) with incredible power and weaponry have waged what many would call Genocide and must be at least acknowledged as Imperalism or Colonialism based on extreme exploitation towards the indigenous people and the planets natural resources and ecosystems."

History is often open to interpretation but I'd argue that the statement given above is irrevocably accurate.

Like I have said before, your assertions are so broad, vague, and unrelated to this topic that they are useless in helping further this debate.

If this is the only argument you can muster to explain every situation presented to us, I think you are at a loss. Making indistinct statements that would require a much larger debate don’t help anyone understand what happened with the DeAnza 8.
